These Terms of Service govern your use of our website and your request for services from Apex Garage & Exterior Solutions, a trade name of Get Your Tarp On, LLC ("Apex," "we," "us," or "our"). By using our website, submitting a request form, or accepting our services, you agree to these terms.

1. Who We Are

Apex Garage & Exterior Solutions is a veteran-owned garage cleanout, organization, storage and exterior services company operating in the Tampa Bay area of Florida. Our legal entity is Get Your Tarp On, LLC, a Florida limited liability company.

2. Requesting Service

Submitting a form on our website is a request for contact. It is not a binding contract and does not reserve a service date. We will contact you to discuss your project, confirm the scope, and provide pricing.

Service areas, availability and scheduling are subject to change. We may decline any project at our discretion.

3. Pricing, Estimates and Payment

Advertised pricing describes a defined scope of work. Anything outside that scope, including add-on storage, cabinetry, flooring, hauling of unusually large volumes, or hazardous materials, is quoted separately.

Your final price, scope, payment terms and any warranty are set out in the written estimate or invoice we provide to you. Where these terms and your written estimate conflict, the written estimate controls for that project.

4. Your Responsibilities

• Provide safe and lawful access to the work area on the scheduled date.
• Remove or point out items that are valuable, fragile, hazardous or must not be discarded.
• Tell us in advance about pets, alarms, gate codes, or anything else affecting access.
• Confirm that you own the property, or that you are authorized by the owner to have the work done.

5. SMS and Text Messaging Program

5.1 Program description

We operate two text messaging programs. Transactional messages cover appointment confirmations, reminders and updates about a job. Marketing messages cover offers and promotions. You choose which you receive.

5.2 How you opt in

Consent is given by ticking the relevant box on our request form, or by texting us first. The boxes are not pre-checked, both are optional, and you can submit the form without ticking either. Consent is not a condition of purchase or of any service.

5.3 Message frequency

Message frequency may vary. Most people receive a small number of messages in the two weeks after a request, and few or none afterwards.

5.4 Message and data rates

Message and data rates may apply. Apex does not charge for text messages. Your mobile carrier may.

5.5 How to opt out

Reply STOP to any message at any time. You may also reply END, CANCEL, UNSUBSCRIBE or QUIT. We will send one confirmation and then no further messages. To rejoin, reply START or submit a new request.

5.6 How to get help

5.7 Carriers and delivery

Delivery is subject to your mobile carrier and is not guaranteed. Carriers are not liable for delayed or undelivered messages.

5.8 Eligibility

You must be 18 or older and be the account holder or an authorized user of the mobile number you provide.

5.9 Privacy

Our handling of your information is described in our Privacy Policy, which forms part of these terms.

6. Website Use

You may use our website for lawful purposes only. You agree not to attempt to gain unauthorized access to it, interfere with its operation, or use it to send unsolicited communications.

All content on the website, including text, images, logos and branding, belongs to us or our licensors and may not be copied or reused without permission.

7. Reviews and Customer Content

If you send us a review, photograph or testimonial, you give us permission to display it in our marketing, with your first name and general location. Tell us in writing if you would prefer we did not, and we will remove it.

8. Disclaimers

Our website and its content are provided as is. We do our best to keep information accurate and current, but we do not warrant that it is error free.

Nothing on our website is a guarantee of a particular result, price or schedule for your specific property. Those are set out in your written estimate.

9. Limitation of Liability

To the fullest extent permitted by Florida law, our total liability arising out of your use of our website or our services is limited to the amount you paid us for the project giving rise to the claim. We are not liable for indirect, incidental or consequential damages.

Nothing in these terms limits any liability that cannot lawfully be limited.

10. Governing Law

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Pinellas County, Florida, and you agree to that venue.

11. Changes to These Terms

We may update these terms from time to time. When we do, we will change the "Last updated" date above. Continued use of our website or our messaging program after a change means you accept the updated terms.
